By accessing or using LobbyFlight's flight information display service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, then you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service, including hotel operators who subscribe to our Service ("Hotels" or "Subscribers").

2. Description of Service

LobbyFlight provides a professional flight information display system for hotels, including:

• Real-time flight departure and arrival information
• Weather information for airports
• Customizable branding and display options
• Multi-language support
• Hotel information rotation displays
• Analytics and reporting features

The Service is designed for display in hotel lobbies and public areas to provide guests with flight information.

3. Account Registration

3.1 Account Creation

To use the Service, Hotels must register for an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Accept responsibility for all activities under your account
• Immediately notify us of any unauthorized use

3.2 Account Requirements

You must be at least 18 years old and have the legal authority to enter into these Terms on behalf of the hotel or organization you represent.

4. Subscription and Payment

4.1 Subscription Plans

We offer different subscription tiers (Basic, Pro, Premium) with varying features and pricing. Details of each plan are available on our pricing page.

4.2 Payment Terms

• Subscriptions are billed monthly in advance
• All fees are in Euros (EUR) unless otherwise specified
• Payment is processed securely through Stripe
• Prices are subject to change with 30 days' notice

4.3 Automatic Renewal

Subscriptions automatically renew unless cancelled before the renewal date. You can manage your subscription through your account portal.

You agree not to use the Service to:

• Violate any laws or regulations
• Display false or misleading flight information
• Interfere with or disrupt the Service
• Attempt to gain unauthorized access to any systems

• Remove or obscure any proprietary notices

6. Intellectual Property

6.1 Our Property

The Service, including its original content, features, and functionality, is owned by LobbyFlight and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

6.2 Your Content

You retain ownership of any logos, branding materials, or content you upload to the Service. By uploading content, you grant us a license to use, display, and distribute it as necessary to provide the Service.

6.3 Flight Data

Flight information is obtained from third-party data providers and is subject to their terms and conditions. We do not claim ownership of flight data.

7. Service Availability and Support

7.1 Uptime

We strive to maintain 99.9% uptime for the Service. However, we do not guarantee uninterrupted or error-free operation.

7.2 Maintenance

We may perform scheduled maintenance with advance notice when possible. Emergency maintenance may be performed without notice.

7.3 Support

Support levels vary by subscription tier:

• Basic: Email support
• Pro: Priority email support
• Premium: Priority support with phone assistance

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LOBBYFLIGHT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use or inability to use the Service
• Any unauthorized access to or use of our servers
• Any interruption or cessation of transmission to or from the Service
• Any errors or omissions in any content
• Inaccurate or delayed flight information

In no event shall our total liability exceed the amount paid by you in the past twelve (12) months for the Service.

10. Indemnification

You agree to indemnify and hold harmless LobbyFlight, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses arising out of or related to your use of the Service or violation of these Terms.

11. Termination

11.1 Termination by You

You may terminate your account at any time through the account portal. Termination will be effective at the end of the current billing period.

11.2 Termination by Us

We may terminate or suspend your account immediately, without prior notice, for:

• Breach of these Terms
• Non-payment of fees
• Fraudulent or illegal activities
• Request by law enforcement

11.3 Effect of Termination

Upon termination, your right to use the Service will immediately cease. We may delete your data after a reasonable retention period.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be notified via email at least 30 days before taking effect. Continued use of the Service after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Austria, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Vienna, Austria.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

15. Entire Agreement

These Terms constitute the entire agreement between you and LobbyFlight regarding the Service and supersede all prior agreements and understandings.
